Welcome to Open EnglishTM and Open English JuniorTM, an online service (the \u201cService\u201d or the \u201cWebsite\u201d) provided by Open Education LLC (\u201cOpen English,\u201d the \u201cBusiness\u201d or the \u201cCompany\u201d). We offer you the opportunity to learn English through our online services and site features, as well as offline via downloads that may be available on the site (collectively, the \u201cService\u201d). We respect your privacy and want you to be aware of the information that we collect about you and what we do with that information. The following Privacy Policy was created in order to help you understand how the information you share with Open English will be used. This Privacy Policy applies to all information that we collect about you.<\/p>\n\n\n\n

Please be aware that Open English may contain hyperlinks to other websites, and these sites may occasionally share the Open English brand or the brand of one of our affiliates. Sites that are connected to the Service or hold the Open English brand may have Privacy Policies that differ from those of Open English.<\/p>\n\n\n\n

3. DATA WE COLLECT<\/strong><\/p>\n\n\n\n

3.1 Registration Information.<\/strong> You are not required to provide us with any personal information to access our website or view the information that we generally provide on our website. However, we may offer you the opportunity to register with us or to join our mailing list and telephone directory by filling out the registration form available on our website.<\/p>\n\n\n\n

3.1.(a)<\/strong> Although registration is not required in order to access our website, you must register and create an account with Open English (\u201cOpen English Account\u201d) in order to use the Service and purchase our instructional courses (“Course”). When you create your Open English account, you will need to provide certain personal information, including your first and last name, a username (which could be your email address), your country of residence, your age, telephone number and a password in order to receive additional information about our services.<\/p>\n\n\n\n

3.1.(b)<\/strong> Additionally, prior to using the Service, you may be asked to provide a credit card or other method of payment, as well as the address where you receive statements for that credit card or payment method. If you give us authorization, we will use this information to facilitate the processing of future transactions using an encrypted system; this system meets the highest security standards and is in line with the regulations issued by credit card associations.<\/p>\n\n\n\n

3.1.(c)<\/strong> As part of the process of creating an Open English account or participating in certain promotions offered by Open English (such as raffles, competitions, surveys, newsletters, etc.), in addition to your name and email address you may also be asked to share certain information about your education and purchasing preferences. Open English may require this information in order to get to know you better, to help you understand new services, programs and offers you may be interested in, and to improve your online experience.<\/p>\n\n\n\n

3.1.(d)<\/strong> Based on the interest you show in joining our telephone directory, the Company may invite you to chat via instant messaging (\u201cChat\u201d) services such as WhatsApp, Instagram, Facebook Messenger or other similar services. If this is the case, you will always be in control of your availability and willingness to maintain a dialog with us. To this end, and prior to initiating any Chat conversation, the Company will send you a message via Chat; we will only be able to continue that Chat for promotional, customer service and\/or technical support purposes if you respond to that message in the affirmative. Please note that depending on your geographic location, mobile device or telecommunication service provider, Chat conversations may be limited or restricted. Please also note that WhatsApp (as well as Instagram, Facebook, Meta and their group of related companies) do not sponsor or endorse our Service. If you have any questions about the functionalities of your Chat messaging account (e.g., WhatsApp), please refer to the terms and conditions of the relevant websites.<\/p>\n\n\n\n

3.2 Automatic Data Collection.<\/strong> You may visit our website and use some of our services anonymously. However, regardless of whether you have registered with us, Open English may collect certain personal information for the use of our services. For example, Open English may collect information on the type of Internet browser you use, the type of computer or operating system you use, your IP address, the speed of your connection, the domain name of your Internet service provider, the geographic location from which you are accessing our services, and\/or the website or advertisement from which you connected to our website. When you use a mobile device such as a tablet or smartphone to access our services, we may access, collect, store and\/or remotely save one or more \u201cDevice Identifiers\u201d on your device. These Device Identifiers are small data files or logical data structures that are associated with or stored on your mobile device in order to uniquely identify that device. Once you have registered with us, we also track and collect information about you including your transactions with us, our affiliates, or other parties, as well as the patterns you followed when using our website, such as the pages you visited, searches you conducted and how long you stayed on our page. Also, if you choose to contact us, we may keep a history of your correspondence.<\/p>\n\n\n\n

3.3 Cookies.<\/strong> When you visit our website, click on a hyperlink found on our site or use one or more of our services, we may use industrial technology known as “cookies.” Cookies store certain information on your computer and allow us to customize your experience so that it aligns with your interests and preferences, or simply facilitate your access when using our services. Keep in mind that if you block the use of these cookies in your browser, you may not be able to use the Service or access our website, or the operation of the page may be affected. However, users of our website and Service may configure their browser to accept or reject some or all cookies. 3.4 Testimonials.<\/strong> Open English may publish testimonials from our customers on our websites, platforms and social networks (“Website”), as well as in television advertising media (“TV”), which may contain personal information. Once you accept the Terms of Service that apply to the Service, you are giving your consent to Open English to publish any of your testimonials or opinions on its Website and TV, as well as your comments, name and any other representation that you may send to us through the corresponding communication channels.<\/p>\n\n\n\n

3.5 Information We Receive from Our Affiliates.<\/strong> Open English may also provide personal information to third parties or affiliated brand pages that we use to provide access to our services (\u201cAffiliated Networks\u201d). When you register with us, the Affiliate Network you used to access our page may provide us with your username and password for that Network. Some of those Affiliated Networks or other networks may share with us any other information that you share. By using our services, you agree to allow us to receive and use any information that you share with Affiliated Networks, except credit card information, under the same terms as if you had shared that information with us directly. Whether an Affiliated Network shares your information with us or not, and to what extent it does so, will depend on your agreement with us and your individual or specific Privacy Policy.<\/p>\n\n\n\n

4. WHAT WE DO WITH YOUR INFORMATION<\/strong><\/p>\n\n\n\n

4.1<\/strong> In general, Open English may use information about you in order to provide and improve the Service. Open English may share this information with content service providers, affiliates and other entities on a non-personal basis for service user demographic studies and preferential information, or for other purposes. This information may include usage and demographic data but will not include personal information (such as your email address).<\/p>\n\n\n\n

4.2<\/strong> As part of the Service, once you purchase any of our services and proceed to interact with instructors, Open English may share this information with service providers for video conferences and webinars (\u201cOnline Meetings\u201d). Please keep in mind that when you use our services, including participating in video conferences and seminars, you will be sending messages to other people and organizations, including third parties outside of the Online Meetings, who will be able to see your messages, content, participation in surveys and any other information you share using your microphone, camera, touch screen or keyboard, as well as other details of your computer, tablet, phone or mobile device settings. Additionally, Open English may send you information about your progress in the form of video messages hosted on third-party websites, which may be viewed by third parties. Although these messages will not identify you by name or photograph, if you do not wish to receive these messages you can ask us not to send them or post them on any third-party website.<\/p>\n\n\n\n

4.3<\/strong> If you provide Open English with personal information, we will take reasonable and appropriate measures to protect this information. Except as described in this Privacy Policy, Open English will not disclose, share, sell or lease personal information collected on our website to third parties for promotional use without your consent, unless it is for a specific program, in which you may request not to participate. If you request to receive information from our affiliates by selecting this option in the future, we may share your registration information and information about your transactions through our Service with the studies and\/or our affiliates. If you access our services through an affiliate version of our website that contains a notice announcing that such information will be shared with that affiliate, which will appear under the name of the affiliate website, any personal or non-personal information will be shared with that affiliate website. Any use of that information by Open English will be subject to this Privacy Policy, and any use of said information by an affiliate will be subject to this Privacy Policy and the Privacy Policy of the affiliate. If Open English sells or transfers part or all of its business and\/or assets to another organization, such as during a merger and acquisition transaction or in the event of a bankruptcy, dissolution or liquidation, our customers’ personal information, such as name and email address and any other information collected through our website or Service, may be one of the business components that is sold or transferred. The resulting buyer or the absorbing or acquiring company will comply with the commitments made in this Privacy Policy. We do not share your credit card account information with affiliated networks or any other third parties, except for the credit card processing service outlined below.<\/p>\n\n\n\n

4.4 <\/strong>In order to keep you informed about our services, we may send you emails and announcements that are necessary for the administration of our website and the Service. We may also provide our users with the option to join our email list in order to receive additional information about our website, services and offers, including updates from our Company or its affiliates. Additionally, we may at some point allow you to choose whether you wish to receive emails from third parties with whom we have an affiliate relationship. You will always be able to change these options by logging in to your Open English account. Each marketing email from Open English will include instructions on how to unsubscribe from the email list.<\/p>\n\n\n\n

4.5<\/strong> We work with third parties who provide services, which may include website hosting, delivery of promotions, order processing, credit card authorization, data analysis, Online Meetings and other services of an administrative nature. Your personal information, including financial information, may be shared with these third parties in order to provide you with these services. We make every effort to impose confidentiality obligations on these service providers. Our Company may also use your information under the terms of this Privacy Policy. Additionally, we reserve the right to disclose personal information to third parties where we believe it is in good faith and is required by law in order to enforce our Terms of Service, protect the rights, property or safety of Open English or the public, respond to an emergency, or as otherwise provided in this Privacy Policy.<\/p>\n\n\n\n

4.6<\/strong> After the termination or deactivation of your account, Open English, its affiliates or its service providers may retain information associated with your profile for a commercially reasonable period for backup, archiving and\/or auditing purposes. Upon your future request, and as required by applicable law, we will delete this personal data or direct you to the appropriate tools.<\/p>\n\n\n\n

4.7<\/strong> Our Online Meeting providers do not disclose our students’ data to third parties, except: (i) to service providers that provide them with technical infrastructure; (ii) when necessary for legal or security reasons; or (iii) to other affiliates (such as Zoom Voice Communications, Inc.) that provide certain services to enable additional products and features for our Courses.<\/p>\n\n\n\n

5. SECURITY<\/strong><\/p>\n\n\n\n

5.1<\/strong> We use reasonable security methods to protect the data stored on our servers. However, no security system is impenetrable; for this reason, we cannot guarantee the absolute security of our servers. Although we use advanced SSL\/TLS certificates (defined in section 5.2) which are used to secure online network communications and establish the identity of websites over the Internet as well as resources on private networks, it is also possible that the information you provide to us may be intercepted during data transmission.<\/p>\n\n\n\n

5.2<\/strong> Every time you provide Open English with sensitive information (e.g., credit card numbers), Open English will take commercially reasonable measures to protect that information and establish a secure connection with our web browser. Open English uses industry standard technology known as Secure Socket Layer (\u201cSSL\u201d) and Transport Layer Security (\u201cTLS\u201d) to protect payment information transmission to the website. You can check the security of your connection by looking at the address bar in your browser window. When you access an SSL-protected server, the first few characters of the address will change from \u201chttp\u201d to \u201chttps\u201d and, depending on your preferred browser, you should be able to see a \u201clock\u201d icon.<\/p>\n\n\n\n

5.3<\/strong> Please help us with your cooperation. To help protect your Open English account information, please keep your password secure. Open English knows that your privacy is very important, and as a result, your password will be stored in our system in encrypted format. If you forget your password, Open English will generate a link to create a new one; this link will be sent to your email address. This will not affect your profile in any way. We suggest that you choose a non-obvious password that contains at least ten (10) characters, which can be numbers or letters. We also recommend that you do not share your password with anyone. Ultimately, you are responsible for keeping your password and Open English account information secret.<\/p>\n\n\n\n

5.4<\/strong> Remember to sign out or log out of your Open English course and close your browser each time you finish using your computer. This measure ensures that others cannot access your personal information since your computer may be accessible to others or shared with other people.<\/p>\n\n\n\n

5.5<\/strong> The Open English Privacy Policy does not extend to anything that is inherent in the operation of the Internet, and thus to anything outside of Open English\u2019s control, and shall not apply in any way that is contrary to the law or government regulations.<\/p>\n\n\n\n

6. TALK TO OUR TEACHERS<\/strong><\/p>\n\n\n\n

During the term of the Course, adults and children will have the opportunity to interact with academic advisors (the \u201cTeachers\u201d) during live online classes and Online Meetings by participating in sessions, games and activities through a virtual classroom and a chat system. Teachers may occasionally employ moderation techniques during live sessions and\/or warn users about the use of inappropriate language in their communication style. We caution and recommend that adults and the children under their supervision who use the interactive platform features on our websites and applications never provide personal information about themselves, either directly or via third parties. Never provide information to circumvent filters or moderation restrictions we may have on our websites and platforms. We also recommend that as a parent or legal guardian you carefully supervise your children while they participate in the activities associated with the Course.<\/p>\n\n\n\n

7. CHILDREN<\/strong><\/p>\n\n\n\n

7.1<\/strong> Please note that the Courses associated with the Open English Junior brand are mainly aimed at children between the ages of 8 and 14. In compliance with the Children’s Online Privacy Protection Act (COPPA) and its subsequent amendments, we will not ask for personal information from anyone under thirteen (13) years of age without parental consent. Anyone who provides us with this type of information is indicating that they are 13 years of age or older. Open English does not collect or solicit any information from anyone under the age of 13, nor does it allow such persons to register for the Service without the consent of their parents, caregivers, guardians or legal representatives.<\/p>\n\n\n\n

7.2<\/strong> The Course activities do not require children to provide any personal information, and as a result, their parents or legal guardians are not required to do so either. However, in connection with certain activities or services related to the Course and Online Meetings, we may collect online contact information such as an email address from a child in order to communicate with them more than once during the length of the Course. To that end, children may receive communication from the Company more than once, and parents or legal representatives may receive a copy of this communication. In order to stop receiving this communication, they would need to opt out of each individual type of communication.<\/p>\n\n\n\n

7.3<\/strong> In any circumstance where we collect personal information from a child, we will only retain that information for as long as reasonably necessary in order to carry out the activities associated with the Course and to ensure the safety of our users and services, as well as to comply with any legal provisions required by applicable law. If we discover that we have collected information from a child in a manner that is inconsistent with COPPA requirements, we will, at our discretion, delete such information or immediately seek parental consent to support the data collection.<\/p>\n\n\n\n

7.4 <\/strong>For more information, please carefully review this Privacy Policy, which explains our processes for data collection, disclosure and practices with respect to the information we obtain from our customers. This policy follows COPPA, which describes our practices in the United States with respect to children’s personal information.<\/p>\n\n\n\n

8. COPPA<\/strong><\/p>\n\n\n\n

8.1<\/strong> Except where permitted by applicable law or with the prior permission of a parent or legal guardian, we do not collect information from children under the age of 18. In accordance with COPPA requirements, on any website or application aimed at children, or in any situation where we ask the age of our users and determine that the child is 13 years of age or younger, we must seek consent from the parents or legal representatives via email prior to collecting any personal information from the child.<\/p>\n\n\n\n

8.2<\/strong> Individuals under the age of 18 but over the minimum age required for consent to use the online services in their country of residence (e.g., 13 in the U.S. or 16 in Ireland) may not create an account with our company and\/or purchase our products or services directly, but they can have a parent or guardian to do so on their behalf and help them ensure that they have access to appropriate content. Individuals under the applicable minimum age required to give valid consent to use the online services may not use our online services. If we learn that we have collected personal data from a child under those ages, we will take reasonable measures to delete it.<\/p>\n\n\n\n

8.3<\/strong> If you believe that your child is participating in an activity that collects personal information and you as a parent and\/or legal representative have not received an email from the Company notifying you of our request for your consent, please do not hesitate to contact us by calling the telephone number published on our website corresponding to your country. When we require your consent for COPPA purposes, we will not send you promotional information unless you have authorized us to do so, or you have participated in an independent activity that allows us to send you promotional information via email.<\/p>\n\n\n\n

8.4 <\/strong>We recognize the privacy concerns of children and encourage parents and guardians to play an active role in their children’s online activities and interests. At any time, parents may revoke their consent allowing us to collect more personal information from their children in connection with a particular user account or services administered by the Company. They may also request that we delete any personal information from our records that we have collected in connection with the account associated with the Course. Please note that a request to delete data records could result in the termination of an account, license or other service administered by the Company.<\/p>\n\n\n\n

8.5<\/strong> In any communication with the Company, such as email or postal mail, please include the child’s username and the parent’s email address and telephone number. To protect children\u2019s privacy and safety, we will take reasonable measures to verify the identity of parents and\/or legal representatives before granting access to any personal information.<\/p>\n\n\n\n

9. THIRD-PARTY ADVERTISERS<\/strong><\/p>\n\n\n\n

9.1<\/strong> Open English may allow other companies, known as ad servers or ad networks, to publish ads from within the Service. These third parties use technology to send the advertisements and hyperlinks that appear in the Service directly to your browser. In these cases, the third parties will automatically receive your IP address. They may also use other technologies (such as cookies, JavaScript or web beacons) to personalize their ads and measure their effectiveness.<\/p>\n\n\n\n

9.2<\/strong> Open English does not provide any personal information to these third parties without your consent, unless it is for a specific program in which you can request to participate. However, please note that if an advertiser asks Open English to push an advertisement to a specific audience or segment of that audience and you respond to that advertisement, the advertiser may conclude that you fit within the description of the audience they wish to reach.<\/p>\n\n\n\n

9.3<\/strong> You should consult the Privacy Policies of these third parties. Open English’s Privacy Policy does not apply to, nor can we control the activities of, these third-party advertisers or other websites.<\/p>\n\n\n\n

10. LINKS TO OTHER NETWORKS<\/strong><\/p>\n\n\n\n

10.1<\/strong> Links to other networks are an integral part of the functionality of the Internet, including our website. Any hyperlink that has a URL from a domain other than openenglish.com in the address bar of your browser is a hyperlink to a page outside of our Service. This includes hyperlinks to our in-service content providers, affiliates, or hyperlinks to third parties that may be associated with Open English. These other networks may send you their cookies, collect data or request personal information. Open English cannot guarantee and is not responsible for the content of other networks or pages.<\/p>\n\n\n\n

10.2<\/strong> Please keep in mind that whenever you provide personal information to other networks or pages (for example, via messaging or chat), that information may be collected and\/or used by people you do not know. Although Open English strives to protect its visitors, their personal information and their privacy, we cannot guarantee the security or privacy of any information you disclose to other websites, and you are doing so at your own risk. 11. SPECIAL NOTE FOR INTERNATIONAL USERS<\/strong><\/p>\n\n\n\n

The Service is hosted on servers located in the United States of America and is primarily aimed at users located on the American continent.
